Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Latent mobile application (the “App”) and any related services (together, the “Service”) provided by Mobile Alchemy LTD (“Mobile Alchemy”, “we”, “us”, “our”). By downloading, installing, or using Latent you agree to these Terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms and Apple’s Licensed Application End User License Agreement (stdeula), Mobile Alchemy grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial use.

2. Free features & paid tiers

Latent is freemium. The App ships with a free tier that includes core photo and video capture, the disposable-roll mode, and a starter set of looks. Paid tiers unlock additional capture modes, looks, manual controls, and pro-grade output formats. Paid tiers are sold as in-app purchases through the App Store and are subject to Apple’s standard payment terms.

Auto-renewing subscriptions

One-time purchases

Latent (mid-tier unlock) and Latent Pro Lifetime are one-time, non-consumable purchases. They do not auto-renew. Restoring previous purchases on a new device is supported via the “Restore” button on the paywall, which calls Apple’s purchase-history APIs through the Adapty SDK.

All purchases are processed by Apple. Refund requests must be made directly to Apple via reportaproblem.apple.com. Mobile Alchemy cannot process App Store refunds.

All photos, videos, and other media you capture with Latent are yours. Latent saves captured media to your device’s Photos library; Mobile Alchemy does not upload, store, or process your media on its servers. You are solely responsible for the content you capture and for complying with applicable laws (including privacy, recording-consent, and intellectual-property laws) in the jurisdiction where you use the App.

We may release updates to the App from time to time. Updates may add, modify, or remove features. We aim to give meaningful notice for changes that materially reduce the functionality of a paid tier, but reserve the right to evolve the product as needed.

8. Disclaimers

The App is provided “as is” and “as available”, without warranty of any kind, express or implied. Mobile Alchemy does not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements. To the maximum extent permitted by law, Mobile Alchemy disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Mobile Alchemy be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the App. Mobile Alchemy’s aggregate liability for any claim relating to the App will not exceed the amount you paid for in-app purchases in the twelve months preceding the claim, or USD 50, whichever is greater.

10. Termination

We may suspend or terminate your access to the App if you materially breach these Terms. You may stop using the App at any time by deleting it from your device. Termination does not entitle you to a refund of purchases already made.

11. Governing law

These Terms are governed by the laws of Mobile Alchemy’s principal place of business, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be brought in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. Continued use of the App after the effective date constitutes acceptance of the revised Terms.
